The Bay Area Infrastructure Financing Authority (BAIFA) proposes to adopt an amended and restated Toll Facility Ordinance for high-occupancy vehicle (carpool) lanes in Alameda County, Contra Costa County, and Solano County operated by BAIFA as Express Lanes (BAIFA toll facilities).
Express Lanes are high-occupancy vehicle (carpool) lanes that also allow any driver to choose to pay a toll to use the lanes during high-occupancy vehicle (carpool) hours of operation, subject to toll facility rules. BAIFA is a joint powers authority of the Metropolitan Transportation Commission (MTC) and the Bay Area Toll Authority (BATA). BAIFA is authorized by California Streets and Highways Code Section 149.7 and California Vehicle Code Section 40250 et seq to adopt the ordinance and construct and operate the Express Lanes. BAIFA currently operates the Express Lanes on I-880, between Oakland and Milpitas, and on I-680, between Martinez and San Ramon. BAIFA’s Express Lanes on I-80 between Fairfield and Vacaville are under construction and expected to begin operations in Fall 2025.
The purpose of the Toll Facility Ordinance is to establish tolling rules for BAIFA toll facilities and to establish civil penalties for the evasion of those tolls or noncompliance with other policies set forth in the ordinance. BAIFA proposes to amend its Toll Facility Ordinance to:
- Add the I-80 Express Lanes in Solano County, which are scheduled to open in Fall 2025;
- Increase the allowable timeframe and parameters for pilot projects on express lanes;
- Increase the minimum toll per zone from $0.50 to $0.75 for all BAIFA Express Lanes;
- Clarify that the Clean Air Vehicle (CAV) discount will end as of September 30, 2025, unless the federal law that allows the discount is amended prior to that date; and
- Adjust the boundaries of the toll zones on southbound I-680 to reflect the gap closure between BAIFA’s and Alameda County Transportation Commission’s express lanes on I-680.
Other minor language clarification and clean-up language is also proposed.
BAIFA will hold one public hearing to receive oral testimony and written comments about the amended and restated ordinance. Copies of the amended and restated Toll Facility Ordinance, together with certain statutes, rules or regulations incorporated therein by reference, being considered for adoption are on file with the Secretary of the Board of BAIFA and open to public inspection at mtc.ca.gov/whats-happening/events/public-hearings. After receipt and review of public comments and testimony, BAIFA will consider the adoption of the amended and restated Toll Facility Ordinance at its June 25, 2025 meeting. Notice of Public Hearing: Regional Measure 3
In June 2018, Bay Area voters approved Regional Measure 3 (RM3), a toll increase on the region's state-owned toll bridges by $1 beginning Jan. 1, 2019, by another $1 in January 2022, and a final $1 increase in January 2025. In fiscal year 2024-25, the RM3 toll revenue is expected to generate approximately $277.3 million in funding for specified capital and operating projects to reduce traffic congestion in the region. Pursuant to Section 30914.7(e) of the California Streets and Highways Code, the Metropolitan Transportation Commission (MTC) is required to consult with the project sponsor and hold a public hearing in advance of consideration of action to program or reassign RM3 funds to a new or other project or modify the project’s scope.
MTC proposes to modify the scope of Project 20. This proposed change is within the same bridge corridor or for investments consistent with the intent of RM3.
At its regularly scheduled March 12, 2025, meeting, MTC’s Programming and Allocations Committee will hold a public hearing on the proposed change to the RM3 capital program described in MTC Resolution No. 4621, Revised, and summarized below:
- Project No. 20, Highway 101-Marin/Sonoma Narrows
- Current Total RM3 Funding: $120,000,000
- Proposed Total RM3 Funding: $120,000,000
- Proposed Funding Change: $0
Action: Modify scope to include the high occupancy vehicle lane hours signage on Highway 101 between Arata Lane in Windsor and North Bridge Boulevard in Sausalito.
Bay Area residents are invited to comment on the proposed funding and scope change to RM3 identified above and further described in MTC Resolution 4621, Revised.
A public hearing to receive public testimony on this proposed funding change will be held during MTC’s Programming and Allocations Committee meeting on:

At the regularly scheduled April 9, 2025 Programming and Allocations Committee meeting, MTC staff will report on public comment received, and the Committee will refer recommendations to the MTC Commission for final action. Notice of Public Hearing
The Bay Area Toll Authority (BATA) proposes to increase the tolls for all vehicles crossing any of the seven state-owned toll bridges in the San Francisco Bay Area (Antioch, Benicia-Martinez, Carquinez, Dumbarton, Richmond-San Rafael, San Francisco-Oakland Bay, and San Mateo-Hayward bridges) pursuant to Section 30918 of the California Streets and Highways Code; and to update the high-occupancy vehicle (HOV) requirements for reduced rate tolls on the Antioch, Benicia-Martinez, Carquinez, Dumbarton, Richmond-San Rafael, and San Mateo-Hayward bridges. The public comment period for the proposed toll increase and HOV policy update will open on Monday, November 4, 2024 and will close at 5 p.m. on Tuesday, December 3, 2024. The toll increase and the HOV policy update are expected to be effective January 1, 2026.
November 12, 2024 update: The public comment period is extended through and until the end of public comment heard on BATA’s toll increase and HOV policy changes agenda item at its December 18, 2024 meeting. All public written and oral comments provided through that time will be incorporated into the record. However, in order for comments to be summarized and published in the agenda packet and distributed in advance of consideration of this item at the December 11, 2024 BATA Oversight Committee meeting, they must be submitted by 5 p.m. December 3, 2024. Oral testimony for inclusion in that summary will be received at the public hearing on November 20, 2024.
